None of our apartments has a regular landline telephone. We can also make one or more cell phones available to you to during your visit for a small. Also, please send us a legible copy of your driver’s license and/or passport or other government identification card with a picture. Additional Terms 1. We strive to protect the privacy and enjoyment of our Guests. Thus, unless requested by you, we will typically not contact you during your NYC visit so as to not interfere with your privacy or visit. Consequently, if – upon move in – Guest sees anything that seems to be inadequate (e.g. about the amenities or cleanliness of the apartment) or broken, please contact us immediately and let us know. Guest and Host agree that – should some situation arise pertaining to this apartment rental that either party considers to be unsatisfactory– that both parties will take reasonable efforts to resolve the unsatisfactory situation between themselves. We wish you to have the most pleasant visit and – if given the chance – we will take great efforts to correct or improve any problem. If you do not contact us promptly, however, we will assume that everything is fine and not be able to resolve the problem. 2. Smoking in the apartment is completely prohibited. Violation of this rule shall permit the Owner to terminate the tenancy immediately without any refund or other recourse to the guest. 3. Guest agrees that s/he shall not use this apartment to engage in illegal activity or to throw parties or otherwise engage in any act that does cause property damage or substantial noise or annoyance that disturbs the neighbors’ quiet enjoyment of their own apartments whether such disturbance occurs inside or in the vicinity of the apartment. Failure to comply with this term may result in the host’s immediate eviction and exclusion of Guest from the apartment without any recompense for any rental money paid for future nights. 4. Guest agrees to pay for the replacement of any missing, damaged and/or broken items in the apartment (Ex. Cushions, artwork, TV, paintings, vase, towels, etc) and/or for special dry cleaning services needed due to extreme usage/damage by the guest or persons allowed entry by guest. Any charges incurred such as for pay-per-view movies, maid service, special clean outs (extremely dirty), additional days renting, damaged and missing items, will be charged to the credit card provided or deducted from the security deposit (if any). 5. Pets require permission: Host does not allow any pets without their consent in advance and pet fee which must be noted in this agreement. 6. Early Check in and Late Check out: All of our guests expect and want a clean apartment. Hence, we must allow time for proper cleaning between guests. This is why we set normal check out at 11 a.m. and check in at 2 p.m. This set schedule allows us to notify guests in advance of their entry time while allowing enough time for our cleaners and maintenance people to make sure the apartment is clean and properly stocked for your visit. 7. Maid Service Not Included. Guest acknowledges that this is simply a furnished apartment and not a Hotel. Maid service is not included in the rent or cleaning fee (though may be available for extra charge). 8. Keys: Unless contrary key arrangements are made in advance, we normally provide one set of keys to any party renting an apartment when moving in. Guest shall not give any key (or copy of such) obtained from Host to any person OTHER than one of the persons named within this agreement as an occupant. When departing from an apartment, Guest shall leave the doors and windows to the apartment closed and locked, leaving all copies of the keys on the counter top in the kitchen or leaving such with an agreed person (like the Superintendent). 9. Broker, Manager and Owner of Property Liable for Gross Negligence up to Contract Amount – Guest understands that there are inherent risks in living in an apartment or home including, but not limited to suffering electrical shocks from outlets and wiring, falling in the shower or down stairs or even falling on a dry and flat surface, cutting oneself on a kitchen knife or on window glass, falling out of a window, gas leak from a pilot light the blows out etc. While Valentine Rentals and the property owners try to minimize these risks, we cannot possibly eliminate or avoid them all. Guest understands and agrees that – absent gross negligence on the part of the owners, manager or broker or other agents of the property owner – the guests are themselves completely responsible for the consequences of any damage or injury resulting from any fall, shock or other occurrence during their stay in one of our apartments. Absent gross negligence on the part of the Property Owner or agents thereof, Guests agree to hold the Property Owner and agents of such Owner and its agents or employees and the owner of any real property harmless against any and all such injuries and damage. Additionally, any liability on the part of Valentine Rentals or Owners for Gross Negligence is limited to and shall not exceed the total dollar amount of this contract to rent such apartment. 10. Cancellation Policy: Should Guest cancel at least thirty calendar days before the first date of occupancy, Valentine Rentals will return any deposit less a 20% administrative fee. Should guest cancel the lease at least three (3) calendar days but less than 30 calendar days before the scheduled occupancy date and the Host (i.e. Valentine Rentals is able to re rent the apartment during the scheduled term, Valentine Rentals will refund the Guest’s rental money paid less (1) any actual expenses incurred (if any) in re-renting the apartment. If the Guest cancels the lease less than 3 calendar days before the scheduled move-in date (or during the scheduled lease rental dates), Valentine Rentals shall not refund any rent except at the complete discretion of Valentine Rentals. In considering whether to give any partial or complete refund, Valentine Rentals will consider any reason(s) and supporting documentation for such cancellation and whether Valentine Rentals is able to re-rent the apartment.
